The Provincial Board of Sorsogon declared invalid Sorsogon City Ordinance No. 010-2023 which authorized the establishment and operation of the Sorsogon Integrated Terminal Exchange(SITEX) of SM Prime Holdings. Inc. under the management of Parks Solutions Inc. that the city council designated as Sorsogon City Grand Central Transport Terminal.
In invalidating the said ordinance the Provincial board reasoned that the existing Memorandum of Agreement between the City Government of Sorsogon and SM PrimeHoldings Inc. are in agreement regarding the terminal fees and other charges including the penal provisions for it falls in the jurisdiction of Parks Solutions, Inc.
It was noted that Section 10 and Section 11 (Sub-section I -VII) does not conform with the Department of Interior and Local Government(DILG) and the Department of Transportation and Communication (DOTC) Joint Memorandum Circular No. 01 of 2008 that establishes the guidelines on the review of local ordinances, orders, rules and regulations concerning public transportation Ordinance No. 010-2023 of Sorsogon City render it invalid.
The Board also requires the City Government of Sorsogon should furnish a copy of the Memorandum of Agreement signed with SM Prime Holdings, Inc. for their review and the existing agreement entered by the parties was reasoned for its disapproval.
